  12. the end of this document prior to installing this 
  13. software. Please read them carefully.  Installing this 
  14. software indicates that you agree to the terms of the

  19. USER AGREEMENT
  20. NOTE:  By installing the screensaver program (the "Program"), 
  21. you signal your acceptance of the following terms and 
  22. conditions.  If you do not agree to these terms and 
  23. conditions, you may not use this Program in any 
  24. manner.

  26. License.  Infocast, Inc. grants you, the end-user, a revocable, 
  27. nonexclusive, nontransferable license to use this Program,
  28. in object code form only, 
  29. on your personal computer.  You may not: (a) disassemble, 
  30. reverse engineer, recompile, decompile or otherwise attempt 
  31. to discover the source code of the Program; (b) make any 
  32. adaptation, modification, improvement, enhancement or 
  33. derivative of the Program; (c) reproduce or distribute the 
  34. Program for a profit, except that distribution of the Program
  35. as Freeware or in a Freeware collection in allowed;
  36. (d) remove, obscure or alter any notice of 
  37. copyright or other proprietary right present on or in the 
  38. Program; (e) use the Program to develop any other 
  39. computer programs; or (f) permit or authorize anyone else to 
  40. take any action described in this sentence.  Infocast may 
  41. revoke this license at any time by written notice.
  42. Ownership.  All patent, copyright, trademark, trade secret 
  43. and other proprietary rights in and to the Program are 
  44. retained by Infocast and are not sold or transferred to you.

  48. You acknowledge that the Program is provided 
  49. "AS IS" and "WITH ALL FAULTS, DEFECTS AND 
  50. ERRORS" and that all use of the Program is AT YOUR 
  51. OWN RISK.  Accordingly, INFOCAST WILL NOT HAVE ANY 
  52. OBLIGATION OR BE LIABLE FOR ANY:  (A)  VIRUS, 
  53. BUG, ERROR, OMISSION, DEFICIENCY OR DEFECT IN 
  54. THE PROGRAM; (B) INABILITY TO USE THE PROGRAM; 
  55. (C)IMPLIED WARRANTY OF MERCHANTABILITY OR

  61. LIMITATION OF DAMAGES.  IN NO EVENT WILL INFOCAST
  62. HAVE ANY OBLIGATION OR LIABILITY (WHETHER IN 
  63. CONTRACT, WARRANTY, TORT (INCLUDING 
  64. NEGLIGENCE) OR OTHERWISE FOR COVER OR ANY 
  65. DAMAGES SUSTAINED BY YOU OR ANY OTHER 
  66. PERSON ARISING FROM USE OR INABILITY TO USE 
  67. THE PROGRAM, INCLUDING WITHOUT LIMITATION 
  68. ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR 
  69. CONSEQUENTIAL DAMAGES (INCLUDING FOR LOST 
  70. PROFITS AND LOST DATA), EVEN IF INFOCAST HAS 
  71. BEEN ADVISED OF THE POSSIBILITY OF SUCH 
  72. DAMAGES.

  74. Entire Agreement.  This User Agreement sets forth the 
  75. entire agreement, and supersedes any and all prior 
  76. agreements, with respect to the Program.
